The following contract contains the conditions and rules of the affiliates program between LifeArt-Boulevard and the websites of the affiliates.
Participation in the affiliates programme
In order to become an affiliate partner of LifeArt-Boulevard and its partners, we would request from you to fill in the registration form completly and in a truthful way. We reserve our right to exclude your website from the affiliates programme and we will inform you promptly of it, if this was the case. We reject any legal claim from third parties to be accepted in the affiliates program of LifeArt-Boulevard. As a general rule we exclude websites that do not comply with the actual laws or that present racist or violent or morally reprehensible contents or that are otherwise similarly questionable.
Should your first application of participation in the affiliate programme be rejected, you could still re-apply after the introduction of the necessary modifications in your website. We will regularly check that your website conforms to our guidelines. Should your website not conform to the rules of LifeArt-Boulevard, we will temporarily block your account as a first measure. Should you not modify it within 7 (seven) days, we will permanently exclude your website from the affiliates programme. The existing balance up to the moment where your malpractice was detected will be then settled.
1. Marketing of the webseite of LifeArt-Boulevard
As an affiliate partner LifeArt-Boulevard offers you at all times a selection of photographs and text links for the marketing of your website. Should you need further links or special photographs, do please contact our support department. The links serve for identification purposes of your webseite and should not be modified. Affiliate accounts the links of which are not connected to our website within 90 days will be ultimately deleted.
2. Use of links
You engage yourself to include exclusively links or pictures of LifeArt-Boulevard. Individual banners or photographs require the authorisation from LifeArt-Boulevard in written form. For this purpose an e-mail will suffice.
3. Use of our partner links
You keep the right to use the links and banners of each of your websites. Simultaneously you are allowed to use the same affiliate ID when you include different websites belonging to you. The setting of exit gates, I-frames, etc. is not allowed and leads to the exclusion from the affiliates programme.
4. Calculation of your earnings. We credit first the amount of 10% of the sales turnover to your account. From it we deduct delivery and packaging costs.
5. Payment of your credit balance
The final crediting of the sales turnover will take place 30 days after the delivery of the goods, due to the fact the we are obliged to follow the law concerning the return of goods. You will find the matching amount in your account overview, once we receive the payment. Should you have a business licence with VAT number, please send it to us via fax or post. In this case you will receive the full credit note regarding the sales turnover. In the case of private individuals or persons without business licence we will direct your VAT details to the fiscal authorities. The payment of your earnings takes place by means of a credit note from the amount of £100,00 every month, via cheque or bank transfer. Sales volumes under £100,00 will be accumulated and paid out at the next monthly opportunity when they reach £100,00.
6. Returns / Customer credit notes
Should merchandises be returned within the legal deadline, your affiliate account will be debited accordingly. You can always check the actual account balance of your affiliate account in the affiliate area.
7. Changes to your personal data
You engage yourself at all times to communicate the changes to your personal data and address to the support department of LifeArt-Boulevard, indicating your affililate ID as well as your old and new address. Failing to comply to your obligation of communication leads in the first place to a warning and, upon repetition of the conduct, to the exclusion from the affiliates programme.
8. Severability clause
Should any of the above mentioned clauses be contrary to the actual or future laws of the German Federal Republic, will these laws be applied. All further conditions remain unaffected.
9. Jurisdiction and legal advice
The jurisdiction for all disputes is the city of Aix-la-Chapelle, Germany.
